xJersey moves a step closer to UNCRC incorporation

Jersey’s Council of Ministers has now approved the Draft Children’s (Convention Rights) Law 202- which means that the draft Law can be lodged and debated in the States Assembly.
The draft law is an example of ‘indirect’ incorporation. Its key component is predicated on the concept of ‘due regard’. In practice, the due regard duty requires groups of duty-bearers to demonstrate consideration of children’s rights alongside all other relevant issues in relation to law, policy and practice. Statutory Children’s Rights Impact Assessments (CRIA) will provide evidence of due regard and support decision making which takes children’s rights into account
