xScottish Government publishes Statutory Guidance on Part 3 of the UNCRC Act 2024

The Scottish Government has issued guidance on part 3 of the United Nations Convention on the Rights of the Child (UNCRC) (Incorporation) (Scotland) Act 2024. Key provisions include a duty on Scottish Ministers to create a Children’s Rights Scheme, which will promote accountability and ensure children's rights are embedded in decision-making.
The Act also introduces a reporting duty for listed authorities, requiring them to publish reports every three years on their actions related to the UNCRC. These reports must detail steps taken to ensure compliance with the UNCRC, and outline future plans for enhancing children's rights. A child-friendly version of the report must also be published.
Additionally, the Scottish Parliament is required to report on its efforts to support children’s rights, with both standard and child-friendly versions to be made available.
Part 3 of the guidance also includes information on updates to the Children and Young People (Scotland) Act 2014, repealing certain reporting duties, but ensuring public authorities complete any outstanding reports for previous periods before transitioning to the new UNCRC Act requirements.
